Terms of Sale
These terms govern use of this storefront and any order placed through it. By using the site you accept them.
The offer and its acceptance
Product pages are an invitation to treat; a submitted order is an offer. A contract forms when the order is accepted and confirmed by email. Until acceptance, items may become unavailable and prices may change; the confirmation email states the items, quantities, unit of sale, and prices that were accepted.
Prices and the unit of sale
Prices are shown in US dollars and include the stated pack count. Where an item is sold as a multi-pack, the price is for the pack as labeled. Prices exclude delivery fees, which are shown before an order is submitted, and exclude applicable taxes, which are calculated at checkout where required.
Prices and availability may change without notice. The price that applies to an order is the one stated in the confirmation email.
Accuracy of listings
Listings are prepared from supplier and catalog data and are checked before publication, but errors occur. Where a listing is materially wrong - a dimension, pack count, or color that does not match the item - the order may be corrected or cancelled and refunded, and the error described under Not as described in the Return Policy.
Images are representative. Color rendering varies by screen, and an item photographed in one finish may be offered in several; the color name on the page governs.
Availability and cancellation
Stock is offered subject to availability. Where an item becomes unavailable after an order is accepted, the affected line is cancelled and refunded and the remainder of the order is fulfilled; the confirmation email and any follow-up email are the record of what was fulfilled.
We may cancel an order, or a line of it, where the item was mispriced or mislisted, where delivery to the address is not serviceable, or where the order appears fraudulent. Cancellation reasons are stated in the email that issues the cancellation.
Delivery and risk
Delivery terms are on the Delivery Information page. Risk in the items passes on delivery to the address given at checkout. Damage in transit is handled under the Return Policy's damaged-parcel process.
Returns
Returns are accepted under the Return Policy, which forms part of these terms. Statutory rights are not affected.
Use of the site
The storefront may be used for lawful purchasing. Automated collection of catalog data, attempts to disrupt the service, and resale of catalog content are not permitted. Product text, images, and the catalog structure remain the property of the site operator and its licensors.
Liability
Nothing in these terms excludes liability that cannot be excluded by law. Otherwise, liability for any order is limited to the amount paid for the items in that order. The site is provided on an as-available basis, and no guarantee is given that the catalog or the service will be uninterrupted or error-free.
Governing terms
These terms, the Return Policy, the Privacy Policy, and the Delivery Information page form the whole agreement for an order. If a court strikes any provision, the remainder continues to apply. Questions about these terms go to support@businesssupplydirect.example.
